Just a thought -- could the FSF and CNRI lawyers beg the question by adding a clause (modifying the one of which they disagree on the GPL compatibility) to the affect: " ... except in so far as this disagrees with GPL license xx applying to the same work." Then the license is manifestly compatible with GPL on this point, because it defers to the GPL here. But the question of whether or not it would have been compatible anyway is still moot. -- -- I won't rest till it's the best ...
